SUBJECT: Bank Accounts

STATEMENT OF QUESTION:

Should the AFA-CWA Board of Directors continue to recognize the practice of establishing bank accounts for the Master Executive Council and Local Executive Council(s) and affirm Master Executive Council and Local Executive Council oversight in all matters pertaining to these accounts?

BACKGROUND INFORMATION:

Current and past practices have allowed the establishment and existence of bank accounts at various AFA-CWA Master Executive and/or Local Executive Councils. The funds held in these accounts have been used for miscellaneous expenditures deemed necessary by the Master Executive Councils and/or Local Executive Councils in the performance of its service to the membership.

Currently the AFA-CWA Constitution and Bylaws does not address the administration of those accounts and the resolution of associated disputes.

PROPOSED SOLUTION:

WHEREAS the AFA-CWA Constitution and Bylaws does not address the administration of bank accounts established for Master and Local Executive Councils, and

WHEREAS the AFA-CWA Constitution and bylaws does not address the process for resolving disputes associated with the administration of said accounts,

THEREFORE BE IT RESOLVED that the oversight of bank accounts established by the International Office for the benefit of Master Executive Councils and/or the Local Executive Councils will be the shared responsibility of the International Secretary-Treasurer and the respective Master Executive Council President or Local Executive Council President, and

BE IT FINALLLY RESOLVED that the language of the AFA-CWA Constitution & Bylaws, Article 1.I. will be amended to add a third paragraph that will read:

Bank accounts opened by a Master Executive Council or Local Executive Council in compliance with the Union’s established procedures shall be the responsibility of the respective Master or Local Executive Council President, and cannot be unilaterally closed or withheld from service by the International Office of this Union, without first taking any associated dispute before the AFA/CWA Board of Directors or the Executive Board, whichever shall convene first, for prompt resolution of said dispute.
